This Privacy Policy (“Privacy Policy”) is a legal agreement between you and OnChain Studios Inc. that covers the collection, use, and disclosure of personal information by us anytime (i) you purchase any Digital Tokens, as defined in Section 1(b) of our Terms of Service (“Terms”) (ii) you license any Digital Collectible (as defined in Section 1(c) of our Terms) as well as (iii) you license, use or access any Service we provide.

Please review the information below, as well as our Terms carefully before accessing the our website located at www.cryptoys.com (the “Site”), purchasing any Product, downloading any application or registering/utilizing our Services, so that you are aware of your legal rights and obligations with respect to our Products, Services or our Company and any of our affiliates, parents and subsidiaries (individually and collectively, “OnChain”, “Company” "we," "us," or “our”).

 

1.     Description:

a. What are Cryptoys? Cryptoys are collections of collectible digital toys, playsets and related accessories on the Flow blockchain network that combine Digital Tokens with Digital Collectibles, as defined in our Terms. Throughout this Privacy Policy, the term “Products” is used to identify Cryptoys as a combination of both Digital Tokens and Digital Collectibles.

 b. What Services we Provide? We provide various capabilities made available through our Site, mobile applications, social media accounts, networking platforms and other technologies (together the “Platform(s)”). Some such services enable you to purchase, manage and interact with our Products. Other such services enable you to use our Products in a variety of games, applications and experiences. All such Platforms, usages, capabilities, applications, games and other services shall be referred to collectively as “Services”.

c. Are there any age restrictions? All Users must be at least 18 years of age, emancipated minors, or possess legal parental or guardian consent, and are fully able and competent to enter into the terms, conditions, obligations, affirmations, representations and warranties set forth in this Privacy Policy and to abide by and comply with this Privacy Policy.

i. Minors Under the Age of 13: If you are under the age of 13, you are prohibited from purchasing our Products and using our Services.

 

2.     What Information Do We Collect?

a.     Information We Collect from Registered Users. You may be required to register an account (“Account”) to purchase any Product or access any Service we provide. Once you’ve registered an Account, you’ll be referred to as a “Registered User.” We may ask for and collect the following information from a Registered User:

                      i.        your name, e-mail address, address, mobile phone number and date of birth;

                     ii.        additional demographic information;

                    iii.        Any information that you voluntarily disclose as part of your purchase of our Products or engagement with our Services; and

                    iv.        Additional information as described in Section 2(c) below.

b.     What if I Don’t Register an Account? If you do not register an Account with us, you’re considered a “Visitor.” Visitors might include those who simply wish to browse, search and examine content and information on our Site. To see what information we collect from Visitors, please read Section 2(c) below.

c.     Information We Collect from Both Registered Users and Visitors. When you visit our Site, Platform or any application we provide as either a Registered User or a Visitor, we collect:

                      i.        Any information that you provide or submit to us directly;

                     ii.        information you send to us by email, sms or any messaging services we engage with;

                    iii.        messages you send or post through our accounts on third party social networks (such as Discord, Telegram, Facebook, Instagram, YouTube or Twitter);

                    iv.        domain names, IP addresses and any information on pages you visit; and

                     v.        information about your usage, such as when you use our Platforms, the frequency and size of data transfers, as well as information you display or click on. If you are logged into your Account, we may associate this information with your Account.

                    vi.        We use third-party services (such as Heap) to help us understand how visitors interact with our Site, Platforms, Products, applications and Services and to help improve our user experience. Heap's privacy options are provided at https://heap.io/privacy.

 

d.     Surveys & Newsletters. We may now or in the future send or run surveys or provide newsletters to our Users. At such time we may request certain identifying information such as name, email address, social media accounts or other communication identifiers (such as Discord, WhatsApp or Telegram).

e.     Click-Through URLs. In some of our emails we may use a “click-through URL” linked to content on the Site or any of our other Platforms. When Users click one of these URLs, they pass through our web server before arriving at the destination page. We may track this click-through data to help us determine interest in particular topics and measure the effectiveness of our communications.

f.      Payment Information. We do not collect any payment information directly. Payment related information is collected by our Payment Processors, as defined in our Terms. Our Payment Processors’ terms of service and privacy policy are provided to you at the point of purchase and links are provided within our Terms. Please review for additional information.

g.     Public Information on the Blockchains. We may collect data from activity that is publicly available on blockchains. This may include blockchain addresses and information regarding purchases, sales, or transfers of NFTs, including our Products, which may then be associated with other data you have provided to us.

3.     How do we use the information you provide us? We use any information collected, as described above, for the following general purposes:

a.     We may use your information to enable purchases of our Products and usage of our Services.

b.     We may use any of the information under our control to improve or to better understand how our Services are used.

c.     Payment Information. We do not process payments directly. When purchasing Products, identifying information entered on our Site or any of our other Platforms may be shared with our Payment Processors. Your interactions with our Payment Processors and any other third-party electronic wallet extensions we may employ are governed by those businesses’ own privacy policies.

                         i.    If you used a credit card to pay for any purchase on the Site or any of our other Platforms, your credit card account information may be subject to verification by the issuing credit card company or other third-party company.

                          ii.    Any information related to your purchase will not be used for any purpose except for the fulfillment and record keeping of the transaction.

d.     We may use your information to contact you in order to answer a question or address a concern that you've raised, or to provide customer service on your Account.

e.     We may use your information to conduct research by sending you a survey.

f.      We may use your information to send certain communications relating to your Account, such as service announcements and administrative messages.

g.     We may use your information to send you marketing and promotional emails. You may opt-out of receiving commercial emails from us at any time by using the unsubscribe links provided in our emails.

h.     We may use your information to improve the quality and design of the Site, Platforms, Products and Services and to create new features, promotions, functionality and services.

4.     Do You Share Any of My Personal Information with Others? We will NEVER sell, license or share any of your information EXCEPT as specifically set below:

a.     Some of our Products are produced under a license with partners (“Licensed Products”). No personally identifiable information will be shared with partners, unless you’ve specifically authorized such sharing at the point of purchase of a Licensed Product or at any time afterwards through your registered Account. In any case where you first permitted us to share your information with our partners, tools will be provided for you through your registered Account to later cancel such sharing authorization.

b.     We may share information collected with our agents, representatives, contractors and service providers so they can provide us with support services such as hosting, analytics, customer support, email and SMS delivery, payment services, and identity verification services (see Section 3(c) for additional information).

c.     We may share information with acquirers and other relevant participants in business transactions (or negotiations for such transactions) involving a corporate divestiture, merger, consolidation, acquisition, reorganization, sale, or other disposition of all or any portion of the business or assets of, or equity interests in, OnChain or our affiliates (including, in connection with a bankruptcy or similar proceedings).

d.     We may also disclose your information when we determine that such disclosure is necessary to comply with applicable law or to cooperate with law enforcement.

e.     We may share information as necessary with law enforcement, government authorities and private parties as we believe necessary to: (a) protect our, your, or others’ rights, privacy, safety, or property (including by making and defending legal claims); (b) enforce the terms and conditions that govern our Platforms, Products and Services; (c) process insurance requirements; and (d) protect, investigate, and deter against fraudulent, harmful, unauthorized, unethical, or any activity that may violate laws, regulations, our public representations, or our contractual obligations.

f.      If you enabled features or functionality that connect our Platforms, Products or Services to a third-party platform or social media network (such as by logging into our Site, applications or Platforms using your account with a third-party, providing your API key or similar access token for the Services to a third-party, or otherwise linking your Account to third-party’s services), we may disclose the personal information that you authorized us to share. We do not control the third-party platforms’ use of your personal information, which is governed by that third party’s privacy policy and terms and conditions.

g.     When you purchase, transfer, use and manage any of our Products some personal data may be made publicly available on the blockchains. This may include blockchain addresses and information regarding your purchase, sale, or transfer of our Products.

h.     Please do not share or provide any information with other users of our Platforms through any tools provided by or through our Platforms unless you’re prepared for any such information to be shared.

i.      We use Google Analytics to help us better understand how people engage with our Site, Services, applications and Platforms. For more information on Google Analytics and their privacy practices, please review their applicable terms of service and privacy policy.

5.     How Does Our Company Protect Your Personal Information? We implement a variety of security measures to ensure the security of your information on our systems.

a.     When completing a paid transaction on our Platforms, your information is protected by our Payment Processors. Please review our Payment Processors’ terms of service and privacy policy for more information.

b.     Please be aware that messages you send to us (whether by email, sms, social media or other systems) are not necessarily secure against interception and you should not include sensitive information in those messages. We generally will not ask for sensitive information in such communications and you should assume that if you get such a request, it might be fraudulent.

  • Except as provided above, the Site is not encrypted.

  • We follow generally accepted industry standards to protect the personal information submitted to us, both during transmission and once we receive it.

  • No method of transmission over the Internet, or method of electronic storage, is 100% secure, therefore, while we strive to use commercially acceptable means to protect your information, we cannot guarantee its absolute security.

  • Third parties may unlawfully attempt to intercept or access transmissions or private communications. Although we work very hard to protect your privacy, we do not promise, and you should not expect, that your personal information or private communications would always remain private.

 6.     Individuals under 13 years of age. Pursuant to the provisions of the 1998 Federal Children’s Online Privacy Protection Act (“COPPA”), our policy is to refuse individuals under 13 years of age access to the Site, Platforms, Products, applications and Services. We therefore do not knowingly collect personal information from individuals under 13 years of age.

7.     Do we Use Cookies? We use "cookies" (small pieces of data we store for an extended period of time on your computer, mobile phone, or other device) provided though our analytics services to analyze the platform’s performance and improve our Services.

8.     How Do I Change Information I Provide You? We provide you with the option of altering information you’ve submitted as part of your Account profile. Please note that we require some Information in order to provide you with access to our Platform and Services. If you wish to delete certain information required for Account maintenance, you may be required to terminate your Account.

a.     You acknowledge that we may retain archived or cached copies of your information.

b.     Please note that not all information monitored, stored, tracked or submitted to us may be edited or removed by you.

c.     The above notwithstanding, we cannot edit or delete any information that is stored on the blockchain. The information stored on the blockchain may include purchases, sales, and transfers related to your blockchain address and NFTs held at that address.

9.     How Long Do We Keep your Information? Except as otherwise provided, your information is maintained by us for as long as it is needed to provide you with access to our Site, Platforms, Products, applications and Services.

10.  Do-Not-Track. The Site does not currently respond to browser “do not track” signals or other similar mechanisms.

11.  California Privacy Rights. California Civil Code Section 1798.83 allows users who are California residents to request certain information about the disclosure of their information to third parties for direct marketing purposes. To make such a request, please contact as provided below.

12.  By visiting or using the Site, Platforms, applications or Services, you consent to the collection and use of information by us as set forth in this Privacy Policy. If we decide to change our Privacy Policy, we will post those changes within this page so you are always aware of what information we collect, how we use it, and under what circumstances, if any, we disclose it. Be sure to review our Privacy Policy regularly so that you will be aware of any changes we make. Please remember that your continued use of this Site, Platforms, applications or Services, and/or maintenance of an Account after changes or revisions have been made constitute your acceptance of such updates.
